WeeklyRides will make a donation to MARS for the support they provide for this ride. The club's amateur radio operators have supported the Assault on Morrow Mountain rides for many years with both SAG support and advanced communications.

Waiver *

In consideration of being permitted to participate in any way in Assault on Morrow Mountain, I for myself, my personal representative, assigns, heirs, and next of kin:

1. ACKNOWLEDGE and represent that I understand the nature of bike rides and that I am qualified and in proper physical condition to participate in the Assault on Morrow Mountain bike ride. I further acknowledge that the Assault on Morrow Mountain bike ride will be conducted over public roads and facilities open to the public during the Assault on Morrow Mountain bike ride and upon which the hazards of traveling by bike are to be expected. I further agree that if, at any time, I believe conditions to be unsafe for riding a bike, I will immediately discontinue further participation in the Assault on Morrow Mountain bike ride.

2. FULLY UNDERSTAND that (a) BICYCLING ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY OR DEATH; (b) these risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the Assault on Morrow Mountain bike ride, the conditions in which the Assault on Morrow Mountain bike ride takes place, or THE NEGLIGENCE OF THE "RELEASEES" NAMED BELOW; (c) there may be OTHER RISKS AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS;

3.  ASSUMPTION OF RISK AND WAIVER OF LIABILITY RELATING TO CORONAVIRUS (COVID-19): (a) Acknowledge and represent that I understand the contagious nature of SARS-CoV-2/COVID-19 (and together with any variants or mutations thereof, "COVID-19") and voluntarily assume the risk that I may be exposed to or infected by COVID-19 during the Assault on Morrow Mountain bike ride and that such exposure of infection may result in personal injury, illness, permanent disability, and death, (b) Acknowledge and represent that I understand that the risk of becoming exposed to or infected by COVID-19 during the Assault on Morrow Mountain bike ride may result from the actions, omissions, or negligence of myself and others, including, but not limited to, THE "RELEASEES" NAMED BELOW, (c) voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my participation in the Assault on Morrow Mountain bike ride (collectively, "COVID Claims"), (d) RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND HOLD HARMLESS THE "RELEASEES" NAMED BELOW from and for all COVID Claims, and (e) understand and agree that this release includes any COVID Claims based on the actions, omissions, or negligence of THE "RELEASEES" NAMED BELOW, whether a COVID-19 infection occurs before, during, or after my participation in the Assault on Morrow Mountain bike ride.

4. RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND HOLD HARMLESS Weeklyrides.com, its officers, volunteers, other participants, any other organizers of the event, the State of North Carolina, the Department of Natural and Cultural Resources, the Division of Parks and Recreation, nor the employees of these entities, any sponsors, vendor, advertisers, and any other parties connected with the Assault on Morrow Mountain bike ride in any way together with their respective successors and assigns, heirs and/or next of kin (each considered one of the "RELEASEES" herein), from and against ALL LIABILITY, CLAIMS, DEMANDS, EXPENSE (INCLUDING LEGAL EXPENSE), LOSSES, OR DAMAGES ON MY ACCOUNT, including death or permanent injury to me (collectively, "Losses"), which may result from or in any way be connected to my participation in the Assault on Morrow Mountain bike ride.

5. GIVE PERMISSION to Weeklyrides.com. and any other of the Assault on Morrow Mountain bike ride organizers and sponsors to use my name and/or pictures taken of me during the ride in promotional materials and publications or for other lawful purposes, and I waive any right to inspect or approve the finished product.

Ride Dismissal and Cancellation

The Assault on Morrow Mountain bike ride organizers may refuse to allow anyone to participate in the Assault on Morrow Mountain bike ride who cause, or who the organizers believe in good faith are likely to cause, a disturbance or hindrance in any manner which could jeopardize the safety of the ride or its participants. The Assault on Morrow Mountain bike ride organizers may also dismiss any such person from the Assault on Morrow Mountain bike ride.

The Assault on Morrow Mountain bike ride may be canceled due to inclement weather or circumstances beyond the control of the ride organizers. If the Assault on Morrow Mountain bike ride is canceled, refunds will not be offered. Weeklyrides.com. nor any of the Assault on Morrow Mountain bike ride organizers will be liable for any costs or expenses that you or anyone else incurs in connection with a canceled event. THE REGISTRATION FEE IS NON-REFUNDABLE. 

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE. I AGREE THAT IF ANY PORTION OF THE AGREEMENT IS HELD INVALID, THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.
